1. Age and Eligibility Requirements

a. Legal Purchase Age: By using our Site and placing an order, you confirm and warrant that you are at least 21 years of age or older, in full compliance with the legal drinking and purchasing age in Indonesia.

b. Age Verification: You acknowledge that 75cl.id will implement age verification measures. This may involve collecting your date of birth, reviewing your ID, or other methods deemed necessary to confirm your eligibility.

c. Consequences of Misrepresentation: Intentionally providing false age information is a serious breach of these terms. If we discover you are underage, or if your age cannot be verified at any stage (including upon delivery), we reserve the right to cancel your order without a refund and may pursue further legal action.

2. Product and Pricing

a. Accuracy: We strive to maintain accurate product descriptions, pricing, and stock information. However, errors may occasionally occur. No agreement is formed until we accept and process your order with a confirmation.

b. Order Fulfillment: In the event of a pricing error, stock issue, or legal restriction (e.g., delivery location), we may choose not to fulfill the order. We will inform you of the issue and offer options such as purchasing at the correct price, delaying the order, exchanging your item for another, or process a full refund if we are unable to proceed with your order.

c. Pricing Changes: Prices are subject to change without prior notice, but any changes will be reflected on the Site. The price you agree to at checkout is the final price, subject to any errors.

3. Payment

a. Full Payment: All orders require full payment, including any associated shipping and delivery fees, before dispatch. Failure to provide full payment is a breach of this agreement, allowing us to terminate the transaction immediately.

b. Third-Party Gateways: We facilitate payments through secure third-party payment gateways, including Xendit. By making a payment, you agree to the terms of these third-party services. We are not liable for any issues, losses, or damages that may arise from their use.

c. Failed Payments: If a payment is returned, denied, or unpaid for any reason, you will be responsible for all associated costs. We may also suspend delivery of any unpaid goods until payment is successfully cleared.

4. Promotions and Offers

Any discounts, coupons, or promotional codes we offer are subject to specific terms and cannot be combined with other promotions unless explicitly stated. Offers are valid for a limited time, as specified, or while stocks last. We reserve the right to modify or revoke any promotion at our discretion and without notice.

5. Shipping and Delivery

a. Service Area: We provide shipping services exclusively within Indonesia using a range of third-party delivery providers.

b. Shipping Costs: Shipping fees are calculated at checkout. We reserve the right to adjust these fees with notice on the Site. If a calculation error occurs, we will contact you before processing the order.

c. Dispatch and Delivery: We aim to process and dispatch all orders within 24 hours of receiving cleared payment. While we provide estimated delivery timelines, actual delivery times may vary and are dependent on our third-party couriers.

d. Recipient and Address: You are responsible for providing accurate delivery details. We are not responsible for incorrect or failed deliveries due to inaccurate details provided by you. You must also ensure that an eligible recipient (21 years or older with valid ID) is available to receive the delivery.

e. Failed Delivery: If a delivery fails due to an incorrect address, recipient unavailability, or failure to meet the age and ID requirements, the package may be returned to us. In such cases, we reserve the right to:

  • Charge additional fees for redelivery.
  • Impose a restocking fee.
  • Cancel the order and refund the total less the original shipping costs and any penalties incurred.
  • No refund will be provided for products where delivery was refused due to the recipient's age or intoxication.

f. Damaged or Lost Goods: We are not liable for packages lost or damaged in transit. We will, however, assist in investigating with the courier. We do not guarantee responsibility or liability for lost or misdelivered orders beyond what is recoverable from the delivery service provider. Our liability is limited to the compensation we can recover from the delivery service, less our administrative costs.

g. Transfer of Risk: The risk for your order transfers to you upon successful delivery to the specified address. For alcoholic beverages, a valid signature and ID verification are required, unless you explicitly authorize an unattended delivery, which assumes you accept all risk from that point.

6. Our Commitment to Responsible Consumption

75cl.id is dedicated to promoting the responsible and moderate consumption of alcoholic beverages. We encourage you to consume alcohol in moderation and be aware of the associated risks. Do not drink and drive!

7. Force Majeure

We will not be liable for any delays or failures to perform our obligations due to circumstances beyond our control, such as natural disasters, strikes, fires, or interruptions in our service providers. In such events, we will either cancel your order or fulfill it as soon as normal operations resume. We will notify you of any significant delays.

8. Disclaimers and Liability

a. General Advice: Any advice or information provided on our Site is for general guidance only and is not a substitute for professional or medical advice. We are not liable for any loss or damage resulting from your reliance on such information.

b. Consumer Rights: Nothing in these terms is intended to exclude or limit any consumer rights you may have under Indonesian consumer protection law.

c. Limitation of Liability: To the maximum extent permitted by law, we exclude all other warranties and guarantees. Our liability for any breach is limited to the cost of replacing or repairing the product, or providing a reasonable alternative remedy. We are not liable for any consequential, direct, or indirect loss or damage.

9. Returns and Refunds

a. Policy: Due to the nature of our products and regulatory guidelines, we generally do not accept returns or refunds for a "change of mind."

b. Faulty Products: If your goods are delivered damaged or defective, please notify us at hello@75cl.id within 48 hours of receipt to arrange a return, exchange, or refund. We may require unboxing video of the package and photographic evidence. We cannot accept returns for opened bottles unless the product is proven to be defective. All returns must be handled in accordance with applicable regulations.

c. Compliance: All returns and refunds are processed in accordance with applicable Indonesian consumer protection law.

10. Intellectual Property

All content, logos, and intellectual property on the Site are our exclusive property. Your use of our services does not grant you any rights to our intellectual property.

11. Dispute Resolution

In the event of a dispute, we encourage you to contact us first to find a swift and amicable solution. Both parties agree to attempt to resolve any issues informally before initiating any legal or tribunal proceedings.

12. General Terms
